การขอประกันตัวในชั้นศาลมี 2 ช่วง
เมื่อผู้ต้องหาหรือจำเลยถูกควบคุมตัวโดยศาล ผู้ประกันสามารถยื่นคำร้องขอปล่อยชั่วคราวโดยใช้หลักประกันได้ดังนี้

หลักประกัน เงื่อนไข/ลักษณะ
1. การใช้หลักทรัพย์เป็นประกัน
- เงินสด
- ที่ดิน มีโฉนด หรือหนังสือรับรองการทำประโยชน์ซึ่งมีหนังสือรับรองราคาประเมินของสำนักงานที่ดิน ซึ่งไม่มีภาระผูกพันอันอาจกระทบต่อการบังคับคดี หากจะนำสิ่งปลูกสร้างบนที่ดินมาเป็นประกันด้วยก็จะต้องแสดงสำเนาทะเบียนบ้าน และหนังสือประเมินราคาสิ่งปลูกสร้างที่น่า เชื่อถือประกอบด้วย
- ห้องชุดมีโฉนดที่ดินและมีหนังสือกรรมสิทธิ์ห้องชุดและต้องไม่มีภาระ

2. การใช้บุคคลเป็นประกัน
