ให้ถูกกฎหมายต้องทำอย่างไร
เมื่อพิจารณาแล้วว่าบ้านหรืออาคารของเราจำเป็นต้องรื้อถอนออก เจ้าบ้านควรยื่นเรื่องขอรื้อบ้านหรือรื้อถอนอาคารจากเจ้าหน้าที่ที่เกี่ยวข้อง โดยขั้นตอนที่ถูกต้องตามกฎหมายมีข้อปฏิบัติต่าง ๆ ดังนี้

ขั้นเตรียมการก่อนรื้อบ้านหรือรื้อถอนอาคาร
ผู้ยื่นขออนุญาตจำเป็นต้องเตรียมเอกสาร เพื่อขอยื่นคำอนุญาตที่สำนักงานเขตหรือองค์กรปกครองส่วนท้องถิ่นที่ดูแลพื้นที่ที่จะทำการรื้อถอนบ้าน เอกสารที่ต้องเตรียมมีดังนี้
1. แบบบ้าน ประกอบด้วย
- แบบแปลนทุกชั้น
- รูปด้าน จำนวน 2 รูป
- รูปตัด 2 รูป
- รายการประกอบแบบ (ครอบคลุมตั้งแต่ขั้นตอนการรื้อถอน วัสดุที่ใช้ โดยลงรายละเอียดให้ครบถ้วนตามหลักการรื้อถอนอาคาร)

3. สำเนาบัตรประชาชนและสำเนาทะเบียนบ้านของผู้ยื่นขออนุญาต
4.ใบยินยอมที่ดิน (ใช้ยื่นกรณีที่ผู้ยื่นขออนุญาตไม่ใช่เจ้าของที่นั้น)
5. บัตรทะเบียนบ้านเจ้าของที่ดิน
6. สำเนาหรือภาพถ่ายโฉนดที่ดินเท่าฉบับจริง
7. เอกสารที่เกี่ยวข้องกับวิศวกรและสถาปนิก
- หนังสือแสดงความยินยอมและรับรองวิศวกรและสถาปนิก
- สำเนาใบประกอบวิชาชีพของวิศวกรและสถาปนิก
- หนังสือแสดงความยินยอมและรับรองผู้ควบคุมงานของวิศวกรและสถาปนิก
- สำเนาใบอนุญาตของผู้ประกอบวิชาชีพ
